Body Corporate Law
Community title schemes, whether for commercial or residential complexes, work smoothly when the management team is properly considering the legal duties of the owner group (the body corporate), where the rules for occupier conduct (the by-laws) are current and in keeping with the interests of unit owners and tenants, and where third parties, e.g. service providers under service contracts, understand and comply with their duties to the body corporate.
Maunsell Pennington can:-
- prepare the legal documents for the scheme (‘Community Management Statement’);
- advise the owner group on duties;
- represent the body corporate in disputes with lot owners or third-party service providers;
- advise on due diligence and transaction handling where a third-party service provider, for example an on-site caretaking and letting manager, is seeking to sell its management rights.
Our firm is a proud sponsor of the Community Titles Institute of Queensland and accepts referrals from its members. |
